1. Agreement to Terms

By accepting a quote, confirming a job in writing, or making any form of payment to Map Masters Ltd ("we", "our", "us"), you ("the Client") acknowledge that you have read, understood, and agreed to these Terms and Conditions. This agreement forms the basis for all services provided.

2. Scope of Services

Map Masters Ltd provides professional services, including but not limited to:
• Drone-based aerial surveys, orthomosaics, 3D models, and topographic mapping
• Geographic Information System (GIS) analysis and visualisation
• Site boundary overlays, custom maps, and spatial data interpretation
• Technical consulting and reporting

All services will be delivered based on the agreed project scope or written quote.

Each Map Standard Package and Map Master Package includes up to three client-requested iterations or revisions. Any additional revisions beyond the three included will incur extra charges at our standard per hectare rate of $65 +GST per hectare.

3. Drone Flight Permissions and Legal Compliance

By accepting a quote or making a payment, you:
• Grant Map Masters Ltd permission to fly drones over the subject property or project area for the purpose of data capture and mapping.
• Confirm that you have obtained all necessary permissions from property owners, tenants, neighbours, or any relevant stakeholders.
• Acknowledge that all drone operations will be conducted in accordance with the New Zealand Civil Aviation Authority (CAA) Rules, specifically Part 101 and, where applicable, Part 102.

Note:
Under CAA Part 101, drones may not be flown:
• Over people without their consent
• In controlled airspace without clearance
• Above 120m (400ft) AGL
• Beyond visual line of sight (BVLOS) without certification
• Within 4km of an aerodrome without prior permission

Map Masters Ltd reserves the right to delay or cancel drone flights if legal restrictions or safety concerns prevent operation.

4. Client-Supplied Data and Accuracy

If you supply existing data (e.g., boundary files, plans, surveys, or GIS layers), you acknowledge that:
• We rely on the accuracy and completeness of the information you provide.
• Our final deliverables are only as accurate as the source data.
• Map Masters Ltd cannot be held responsible for errors, misalignments, or incorrect conclusions resulting from inaccurate, incomplete, or outdated client-supplied data.

Where high-precision outcomes are required (e.g., engineering or legal boundaries), it is your responsibility to ensure the data provided meets the necessary standards.

5. Quotes, Pricing, and Payment Terms

• Quotes are valid for 14 days from the date issued.
• A 50% deposit is required before scheduling a site visit for first-time customers.
• A 25% deposit is required before work commences for recurring customers.
• All deliverables will be watermarked or marked as "Inaccurate Draft" until final payment has been received in full.
• Final payment is due within 7 days of the invoice date.
• Payments made via credit card or any card-based payment system will incur a 2% surcharge, payable by the client.
• Late payments may incur a 2% monthly interest charge on outstanding amounts.
• GST is additional unless specifically stated.
• Deliverables remain the property of Map Masters Ltd until payment is received in full.

Additional work outside the agreed scope will be billed at our current per-hectare rate.

6. Rescheduling, Delays, and Cancellations

• Work may be postponed due to poor weather, unsafe site conditions, or airspace restrictions.
• If cancelled by the client within 48 hours of the scheduled job, a 25% cancellation fee may apply.
• Rescheduling due to weather or flight restrictions will be arranged at no extra cost.
• A no-show or site inaccessibility on the day may incur a call-out charge.

7. Site Access and Client Responsibilities

You are responsible for:
• Providing clear and legal access to the site
• Identifying hazards or environmental constraints (e.g., power lines, wildlife, cultural sites)
• Ensuring that landowners and relevant parties are aware of upcoming drone flights
• Notifying us of airspace restrictions, protected areas, or special considerations

If access is denied or unsafe, we may reschedule or refuse service.

8. Intellectual Property and Licensing

• Raw drone data, processed imagery, GIS layers, and analysis remain the intellectual property of Map Masters Ltd, unless otherwise agreed in writing.
• You are granted a non-exclusive, non-transferable licence to use the final deliverables for the intended purpose.
• Reuse or redistribution for unrelated projects or resale requires our written consent.

9. Confidentiality

Both parties agree to treat any commercially sensitive or non-public information as confidential. No data or project details will be shared with third parties without mutual written agreement, except where legally required.

10. Liability and Indemnity

• We take care to deliver accurate and timely work using best practices and industry tools. However, Map Masters Ltd shall not be liable for any loss or damage arising from the use of data for purposes beyond its stated intent.
• Our maximum liability is limited to the total amount paid for the specific project or service in question.
• You agree to indemnify Map Masters Ltd against any claims, losses, or liabilities arising from the unauthorised use of deliverables, unsafe site conditions, or your failure to obtain proper flight consents.

11. Customer Feedback

We welcome and encourage clients to leave feedback or a public review after completion of a project. While reviews are not mandatory, they help us continue to improve and serve the community better.

12. Governing Law

These Terms and Conditions are governed by the laws of New Zealand, and any disputes will be handled under the jurisdiction of the New Zealand courts.

13. Amendments

We reserve the right to amend these Terms at any time. The most up-to-date version will be provided upon request and included in all new client engagements.
